On January 22 the judge hearing Wendy Clark's lawsuit regarding the Parker resort issued a 60-page opinion finding in favor of Wendy on one count, and ruled that approval of the resort and rezoning of the land on which it sits is now void.
The judge ruled that the City of Galena violated Wendy's right to procedural due process in the way that the Zoning Board and City Council had gone about approving the resort. In particular, the City denied the right to cross-examine those testifying during public hearings.
There is still much to digest regarding the ruling, but the bottom line is that the court said that the way the City conducts its process matters, and the right of citizens to participate fully in that process is essential.
The resort cannot be built without the developer submitting a new application and the City starting the process again from the beginning.
