The following is an update on the lawsuit regarding the City's approval to build the Parker resort in Galena.
You may remember that the City and the developer from Wheaton, IL, David Hooten, requested that the judge reverse the decision he made in favor of Wendy Clark. The judge ruled in January that the City of Galena had violated Wendy's rights, which meant that if Mr. Hooten wants to build the resort, he must ask the Zoning Board and City Council to start the process over again.
The City has thus far spent over $130,000 to fight Wendy Clark on the lawsuit and to allow Mr. Hooten to build his giant resort.
The next status hearing and the judge's decision on the request to "reconsider" his opinion was expected in mid-August. We have learned, however, that this court date has been moved to September 26. We believe that nothing should be read into this delay, other than that it reflects the realities of court calendars.
